(1) A detainee or prisoner who has been detained or imprisoned for a specified period of time, after the expiry of that period and empowered according to the prevailing Nepalese laws, as amended by the Act, 2048 to amend certain Nepal Acts. If the Chief Judge or Judge of the Court of Appeal orders the immediate release of a prisoner or detainee, and if he observes anything else that is not in accordance with this Act during the inspection of the prison, he shall disclose that matter and send a report to the Supreme Court and the Government of Nepal, the Ministry of Home Affairs.
(5) If any detainee or prisoner is detained or imprisoned for a longer time than according to the prevailing law due to the harassment of an employee, or if any other thing is found to be not or not done according to this Act, such employee will be punished by departmental action.
